In compliance with art. 13 of European (EU) General Data Protection Regulation 2016/679 (GDPR),* this privacy notice explains how we process your personal data when you register, request, book, or purchase entry tickets, passes, and invitation to participate in the event above.

Personal data to be entered in the registration or accreditation forms (e.g. identification data, email, position in and division of the company, telephone numbers) are collected and processed by the Data Controller, i.e. Fiera Milano S.p.A. (“Fiera Milano” or “our Company”).

Our Company will process your personal data for the following purposes: managing your registration or accreditation, issuing or sending tickets, providing services related to the chosen event, meeting legal requirements, and carrying out administration and accounting activities. Therefore, the processing of your personal data is necessary for us to execute the contract regarding access to the event, comply with legal obligations, and pursue the legitimate interests of our Company to manage the administration, organizational, technical and security-related activities related to your participation in the event and provide the relative services. During the event, photographs and videos may be taken of the stands, areas, events etc., that are open to the public and where images of Visitors may be shot or recorded that will be used by Fiera Milano and disseminated, also on social media and websites, for the pursuit of legitimate interests regarding information and publicizing of the event.

If you do not provide the data or some of the data marked in the form as required, it may be impossible for us to complete the registration or application procedure. However, providing certain additional data that may be useful for improving our services and facilitating contacts with you is optional. 

For these purposes, personal data will be processed also electronically, through specific, mainly computerized, procedures and methods to ensure the correct management of the services provided. These data may be retained even after the event for administrative and accounting activities and tax obligations, for a period set out in applicable standards (usually ten years).

For these purposes, personal data can also be communicated to personnel and collaborators we authorize to process data for carrying out said administrative, technical, and security-related activities related to the organization and management of the event. We may also communicate your data to other companies in the Fiera Milano Group (see updated list on www.fieramilano.it) and trusted companies that, as data processors, provide us with organizational and technical services relevant to the event, such as installers, support and maintenance companies, printers, data processing companies, administrative consultancy firms, and companies appointed to measure the performance of the event. The companies that process personal data on behalf of Fiera Milano S.p.A. operate as data processors meeting the specific obligations set forth in the relevant service contracts. For these purposes, personal data can be transferred to companies outside the EU, if the European Commission has recognized that these countries offer an adequate level of data protection (e.g. Switzerland, Australia, Israel, and USA for companies complying with the Privacy Shield framework), of based on suitable guarantees (such as standard contractual clauses or binding corporate regulations) or, should these conditions not be fulfilled, if said transfer is authorized by the Visitor or necessary for executing the contract.

The email and postal addresses you provide when you register or request tickets, passes, and invitations can be used by our Company to send the newsletter of the event and related Fiera Milano and the Group’s activities, as well as communications regarding similar events and services. You can object at any time (immediately or also subsequently) to the sending of these communications by email writing to privacy@fieramilano.it or by post to the addresses indicated below.   

In addition to processing your personal data for sending (by post or email) newsletters and communications regarding the event and services you are interested in, our Companies may process your data – prior consent to be provided by ticking the box at the bottom of the form – for the following purposes:

• a) sending advertising and direct sales materials and performing market research or sending commercial communications by post, telephone, automated calling, fax, e-mail, text message, mms systems on other events, services and products of our Company and Fiera Milano Group (see updated list on fieramilano.it), as well as third parties (organizers, exhibitors, installers, qualified operators involved in the events or operating also in other sectors) with favorable commercial offers for visitors;
• b) analyzing the data to identify, also using electronic or automated means, their preferences and any services and products they may be interested in (profiling);
• c) sharing data with other Fiera Milano Group companies and other companies, including organizers, exhibitors, installers, qualified operators involved in the events or operating in other sectors, such as market research institutes, Fiera Milano sponsors and suppliers for their processing, as Data Controllers, for the purposes and with the methods specified in section a).

In any case, the provision of these data remains optional and does not affect your registration to or participation in the event. Moreover, you are entitled to withdraw consent without affecting the lawfulness of processing based on consent before its withdrawal.

Under the GDPR (articles 15-22), you have the right to access your data at any time, obtain a copy, rectify or complete them (if incorrect or incomplete), erase them or restrict their processing when the grounds occur, object to their processing on grounds relating to your particular situation and for direct marketing purposes, request data portability if processed by automated means for the execution of the contract or based on your consent, and lodge a complaint with your Data Protection Agency if you think your rights have been infringed.

*The GDPR applies to the processing of the personal data of natural persons and not of companies, organizations and associations (e.g. company name, registered office, line of business). Specific rules on electronic commercial communications remain applicable to legal entities. For this reason, Visitors are required to provide their consent for direct marketing purposes, even if they are a company.

The User is required to accede to the Terms of Use of the Service set out below to access and use the Service called "Smart Lunch". To accede to the Service, the User shall accept the applicable section which can be reached when the Service is accessed for the first time.

The following definitions apply for all purposes in the scope of the Terms & Conditions of Use of the Service:

• Fiera Milano S.p.A. (hereinafter, also "FM"): this is the legal entity (with registered office in Piazzale Carlo Magno 1, 20149 Milan, Italy), which manages the "Smart Lunch" platform (hereinafter, the "Platform");
• Users (hereinafter, also the "User/s") are the subjects who utilize the service;
• Catering services Providers (hereinafter "Providers") are the subjects who make the products made available on the Platform.

Subject

Fiera Milano has developed a Platform through which several Providers offer and/or may include a selection of products. The customers may request the purchase and/or pick-up of products from the Providers in person or have them delivered to the address indicated on the Platform.

The delivery times present in the Platform have to be considered as indicative.

Terms of Use

Upon Joining the Platform, the Users are aware and accept the Terms of Use, the Privacy Policies, and the Cookie Policies.

Access and registration for customers

The requirements necessary to become a Platform User are:

• To be at least 18 years old.
• To have truthfully filled in the fields requiring personal information, such as user name, e-mail address, telephone number and credit card number.
• To have accepted these Terms of Use.
• To have accepted the Privacy and Data Protection Policy
• To have accepted the Cookie Policy 

The User declares that all information concerning identity and qualification provided to Fiera Milano for the Platform is true, accurate and complete.

If a User provides false, inaccurate or incomplete information or if Fiera Milano has well-founded reasons to doubt the truthfulness, accuracy or completeness of such information, Fiera Milano may deny the User current or future access to the Platform, or use of the Platform or of any of its contents and/or services.

Users will be solely responsible for any use of the data or services on the Platform.

Access to the Platform and use

Users are required to provide information, such as name, surname, e-mail address, telephone number, etc., to place an order on the Platform. Fiera Milano does not store users' payment data, which will be processed and saved by the payment service provider as described in these Terms and Conditions and in the Privacy Policy.

Operation of the service. Terms of the mandate

Registered Users must go to the online platform and use the available electronic methods to request the service. The basic service includes pick-up at the refreshment point or delivery to the stand within the entire exhibition perimeter.

The User will be solely responsible for providing correct information regarding the delivery service in the Platform and thus indemnifies Fiera Milano for any error regarding the delivery due to incorrect information provided. Considering that, the User will be responsible upon any costs related to incorrect address.

The User must provide all the necessary information related to the desired product. These information must be added in the “Comments” section of the Platform.

The User may call the telephone number found in the section of the venue chosen to provide the service to contact the Provider or Fiera Milano after placing an order, if required.

If the product and/or service is not available, the Provider shall contact the User to define the available options.

The delivery will be made within the time period requested by the User. The User will be asked to sign a delivery form containing the following information:

• company name,
• person identified for pick-up
• delivery time
• date
• signature for receipt

FOOD/PACKED PRODUCTS: Fiera Milano advises Users to check the Providers' allergen information made available on the Platform when ordering food.

Prices of services and billing

Registration and use of the Platform is completely free for Users.

The User shall pay for the requested service through the Platform using a credit card.

To utilise the service, the User must place a minimum order of EUR 20, including VAT, paid by credit card. The order will be valid after the transaction has been authorised.

A service charge of EUR 3 (VAT included) will be applied for deliveries.

Fiera Milano reserves the right to change the prices at any time. Any changes will take effect immediately after publication. The User expressly authorises Fiera Milano to send the order confirmation for the service which is subject of the contract by electronic means to the e-mail address provided by the User during the registration process.  An invoice may be requested after entering all the required tax data. The invoice will be sent via SDI.

Payment platforms

To provide greater support to Users, Fiera Milano will be their first point of contact and will accept responsibility for payments made on the Platform. This includes refunds, returns, cancellations and resolution of disputes at an early stage and will not adversely affect any action that may be taken by Fiera Milano with respect to local establishments as sole physical vendors of the products ordered by Users.

In case of problems concerning the progress of an order, Users may contact either the Provider directly or Fiera Milano Customer Care through the methods made available to Users on the Platform.

Price of Products and/or Services indicated on the Platform

All prices shown on the Platform include applicable taxes. The prices applicable to each service/product shall be published on the Platform. However, the User is aware that the price of some products may change in real-time. 

Right of withdrawal and cancellation of orders

Given the nature of the service offered by Fiera Milano, Users are aware that, once an order has been accepted, the purchase is considered to be initiated and that they are thus no longer entitled to withdraw from the request for the service free of charge.

The total cost of the order will be charged to the User if the venue accepted the order and started preparing it. The User will be informed of the Provider's acceptance via the Platform and/or e-mail at the e-mail address indicated by the User.

If an incorrect delivery address was given for the products, the User may contact the Provider and notify the new delivery address.

Fiera Milano reserves the right to cancel an order without explanations. In case of cancellation by Fiera Milano, the User will be entitled to a refund of the amount paid.

The customer shall send the refund request by e-mail to servizio.gestori@fieramilano.it attaching a copy of the order confirmation and the bank details for the refund by bank transfer.

Special terms of purchase Service ordered through Fiera Milano

To know the ingredients and nutritional information of the products available on the Platform, the User may check the allergen information published on the information sheet of the venue or alternatively contact the Provider directly (using the contact details provided by Fiera Milano for the User's convenience) to access all information on the products.

After selecting one of the options, the User may complete the order using the free text space provided to include more detailed information or instructions.

The photographs of the products are for illustrative purposes only. The User shall refer to the product ingredients.

Furthermore, the User accepts that all products on the Fiera Milano Platform are subject to availability and accepts the possibility that the product and/or service may not be available to the Provider during the fulfilment of the order.

Fiera Milano reserves the right to withdraw any product from the Platform and to modify the content of its information sheets at any time, without incurring any liability of any kind.

Price and payment method

The price of the product and/or service must be indicated by the Provider on the Platform.

Similarly, during the payment process, the User will be informed of the final price and will be asked to choose the time slot in which the service is requested.

The User shall pay for the products by credit card upon confirmation of the order.

The receipt and a courtesy copy of the invoice, if required, shall be attached to the product upon delivery or pick-up.

Orders with pick-up

Customers may order a selection of products offered by the Providers using the PICK-UP option. The PICK-UP service allows users to physically pick up orders directly from the Providers. Fiera Milano offers the possibility to contact the Provider or the Call Center for any problem related to the pick-up service.

The User shall contact the Provider directly to change an order or if the preparation is delayed at the restaurant.

Once the order has been confirmed, the order number will be sent by e-mail and must be shown to the staff at the venue when the order is picked up. 

The price of orders placed via the PICK-UP option will not include additional delivery costs.

Purchase of alcoholic beverages

Users placing an order which includes the purchase and/or delivery of alcoholic beverages through the Platform must be of legal age, i.e. 18 years of age or older. By accepting these Terms and Conditions of Use, the User confirms being at least 18 years of age.

User's obligations

Users are fully responsible for the use of and access to their profile and other contents of the Platform in accordance with the national and international current legislation of the country in which they are using the Platform, as well as with the principles of good faith, morals, generally accepted customs and public order. Specifically, they undertake to comply with these General Terms of Use diligently.

Users are responsible for correctly entering their individual data, which must be non-transferable, to protect their account from fraudulent use by third parties not belonging to the Platform.

Users shall refrain from using their profile and other contents of the Platform for illegal purposes or with illegal results which prejudice the rights and interests of third parties or which may damage, disable, impair or compromise the Platform, its contents and services in any manner.

Anyone who breaches the above obligations shall be liable for any loss or damage caused. Fiera Milano shall not be liable for any consequence, loss or damage which may result from such illegal use or access by third parties.

Responsibility of Fiera Milano

Users are responsible for providing the services and equipment necessary to surf the Internet and access the Platform. Users can report any incident or problem in accessing the Platform to Fiera Milano through the contact channels available to Users. Fiera Milano will analyse the incident and instruct the User on how to solve it as soon as possible.

Fiera Milano shall not be liable for any interruption of service, connection error, unavailability or malfunctioning of the Internet access service, Internet interruptions or any other matter beyond its control.

Responsibility for content

Fiera Milano does not control the way Users utilise the Platform. Therefore, Fiera Milano does not guarantee that Users will use the Platform in accordance with these General Terms of Use in a diligent and/or prudent manner. Fiera Milano does not verify (nor is obliged to verify) the identity of Users or the truthfulness, current validity, completeness and/or authenticity of the data provided by them.

Fiera Milano will not check the products sent or delivered through orders on the Platform. Therefore, both the User and the Provider indemnify Fiera Milano against any liability which may arise from the availability and/or transport of products requiring specific permits or licenses, or products prohibited by any applicable legislation.

Fiera Milano rejects liability for damage of any kind deriving from the illegal use of the Platform by Users or due to untrue, invalid, incomplete and/or false information provided by Users to other Users and, in particular and without limitation, for any loss or damage of any kind that may result from a User impersonating a third party in any communication made through the Platform. In particular, Fiera Milano shall not be liable for the use of the application or for any order placed by a third party from the User's account.

No guarantee for appointments or payments

Fiera Milano does not provide any guarantee regarding the authenticity, accuracy, novelty, reliability, legality or non-violation of third party rights by the Providers.

Platform updates and changes

Fiera Milano reserves the right to change these General Terms of Use, Privacy Policy and Cookie Policy at any time without prior notice. Users shall read these General Terms of Use carefully when accessing the Platform. In any case, acceptance of the General Terms is an essential step to be taken before accessing the services and content available through the Fiera Milano Platform app.

Furthermore, Fiera Milano reserves the right to update, modify or delete the information contained on the Platform, at any time and without the need for prior notification, with regard to its layout, presentation and access conditions, therefore without accepting any liability relating thereto. Fiera Milano does not guarantee the absence of errors or interruptions when accessing the Platform or its content, or that it will always be updated. Without prejudice to the above, Fiera Milano shall take all necessary actions to correct such errors, restore communication and update obsolete contents except in case of circumstances that make it difficult or impossible.

Intellectual property

The User acknowledges that Fiera Milano is the sole owner of the copyright, intellectual and industrial property rights of the Service supplied, of the software and all the documentation provided, and undertakes to behave appropriately to protect such right.

Separability

If any clause of these General Terms is held to be invalid or void by law, it shall be deemed as not included. Such declaration of invalidity shall not cause the rest of the Agreement to be null and void and the Agreement shall remain valid and in force between the Parties.

Applicable law

These Conditions are governed by Italian law according to which they must be interpreted. Without prejudice to the mandatory provisions of the law, the Court of Milan has exclusive jurisdiction to settle any dispute concerning these Conditions and the relationships governed thereby. These Conditions are available in Italian and English. The Italian version shall prevail in case of conflict between the two versions.
